Terms of Service

    1. Introduction

    Welcome to dLogos.xyz (“we,” “our,” or “us”). By accessing or using our website, services, and applications (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). These Terms affect your legal rights and obligations, so if you do not agree to these Terms, please do not use the Services.

    2. Using the Services

    You may use our Services only if you can form a binding contract with dLogos.xyz and are not a person barred from receiving services under the laws of applicable jurisdictions. You must be at least 13 years old to use the Services. If you are accepting these Terms on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so.

    3. User Accounts

    To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your account.

    4. Content and Conduct

    Our Services allow you to create, post, share, and store content such as petitions, text, links, and other materials. You retain any rights that you may have in the content you post. By submitting content to the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.

    You agree not to post content that is illegal, fraudulent, misleading, defamatory, obscene, or otherwise objectionable. We reserve the right to remove any content that violates these Terms or that we determine is otherwise harmful to our Services or users.

    5. Petitions

    dLogos.xyz enables users to create and support petitions. By creating a petition, you agree to be fully responsible for the content and objective of the petition. By signing a petition, you agree that your information may be displayed alongside the petition and shared with the petition creator and target.

    6. Pledges

    A pledge is a conditional authorization, not a purchase and not a payment. When you confirm a pledge, dLogos asks its payment processor to save your payment method. Nothing is charged at that moment, no amount is held against your balance, and no part of your pledge is captured up front.

    • Your card is saved now. Nothing is charged or held.
    • You are charged only if the episode is published within 90 days of your pledge.
    • Revoke any time before that, and nothing is charged.
    • Before you confirm you see the exact amount earmarked for the beneficiary and the dLogos platform fee.
    • dLogos releases the earmarked amount as your agent, not as its recipient. Your name and amount are shared with the beneficiary for its records.

    6.1 Our role

    dLogos processes this payment as your agent, not as the recipient of the earmarked portion you direct to the named organization.

    6.2 What you authorize

    Before you confirm, the pledge flow states three figures: your pledge total, the dLogos fee as an exact dollar amount for that total, and the earmarked amount, which is the total minus the fee. By confirming you authorize both amounts: the fee, retained by dLogos for payment processing and campaign operations, and the earmarked amount, directed by you to the organization named in your pledge.

    The fee is stated as a dollar figure rather than a rate, because the fee is the greater of a fixed minimum and a share of the total. On a small pledge the fixed minimum is what applies, so a rate would understate it.

    The organization is assigned to the nomination before pledging opens, and it is named, with its registration number where we hold one, in the terms you agree to. It cannot be changed once a confirmed pledge exists against that nomination: an abandoned draft or a failed attempt does not lock it, and a confirmed one does. Your own pledge records the organization it named, so a later change to the assignment cannot redirect it.

    6.3 When you are charged

    There is a single charge, if and when the episode is published, within the window stated to you before you confirm and recorded in your pledge. If the episode is not published inside that window, the pledge lapses and no charge is made. There is nothing to refund in that case, because nothing was taken.

    You can renew that window once. No pledge stays open longer than 180 days from the day you first confirm it.

    6.4 Cancelling a pledge

    You can revoke this pledge in full any time before the episode is published, and nothing is charged.

    6.5 Your identity

    A pledge carries a setting that controls whether your name appears on public pledge surfaces. That setting does not control what the receiving organization is told: your identity is shared with the organization that receives the earmarked amount either way, so that it can acknowledge the contribution it received. The pledge flow states this next to the setting, before you choose.

    6.6 Records we keep

    A completed pledge is a financial record. We retain the pledge, the amounts, and the exact terms you agreed to, including after an account is closed, because we have to be able to show what was authorized and what was paid. See our Privacy Policy for how that information is handled.

    6.7 Tax treatment

    Pledges are not tax-deductible. dLogos is not a charity, and it directs your earmarked contribution as your agent.

    dLogos does not issue tax receipts. Speak to your own adviser about your own position.

    7. Termination

    We may suspend or terminate your access to the Services at any time for any reason without notice or liability. Upon termination, your right to use the Services will immediately cease.

    8. Disclaimers and Limitations of Liability

    The Services are provided “as is” without any warranties, expressed or implied. We do not warrant that the Services will be uninterrupted or error-free, or that any defects will be corrected.

    To the maximum extent permitted by law, dLogos.xyz will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Services.

    9. Changes to Terms

    We may modify these Terms from time to time. If we make changes, we will provide notice of such changes by revising the date at the top of these Terms or by providing other types of notice. Your continued use of the Services after any modification constitutes your acceptance of the modified Terms.

    10. Governing Law

    These Terms shall be governed by the laws of the jurisdiction in which dLogos.xyz operates, without regard to its conflict of law provisions.
